CANCELLATIONS - The Royal
Lahaina
Resort, hereafter referred to as the "Hotel" and the bride and groom, hereafter referred to as the "Wedding Couple" agree that in the event the contracted event does not take place, the Hotel would suffer damages that would be difficult to determine. Such damages would include, but not be limited to, losses of revenue from food and beverage events and other revenues generated by events. Therefore, if the Wedding Couple elects to cancel this agreement for any reason other than a termination for cause, they agree to provide written notice to the Hotel accompanied by a liquidated damage payment as indicated in the following scale:
If notice of cancellation is received: |
The cancellation Charges will be: |
From date of Contract signature to 12 months prior to event/wedding |
10% of anticipated revenue |
12 months to 6 months out |
20% of anticipated revenue |
6 months to 3 months out |
50% of anticipated revenue |
Within 90 days of arrival date |
80% of anticipated revenue |
The option to cancel is agreed by both parties to constitute the exercise of a contractual option and not a default. Both parties further agree that the amounts set forth above are reasonable estimates of the damages that would be incurred by the Hotel and include consideration of the possibility of the hotel's ability to mitigate its losses through resale. Payment must accompany notice of cancellation in order to constitute a valid exercise of the cancellation option at the agreed amount of damages.
DATE CHANGES - In the event the Wedding Couple is forced to change the date of the wedding every effort will be made by the Hotel staff to transfer location reservations, sub-contractors and Hotel support to the new date. The Wedding Couple agrees that in the event of a date change any expenses including, but not limited to, deposits and fees that are non-refundable and non-transferable are the sole responsibility of the Wedding Couple. There may also be additional charges above and beyond those set forth in the Cancellations section above. The Wedding Couple further understands that changes within 30 days of the wedding event can impact the quality of the event and that the Hotel is not responsible for these compromises in quality.
